Abstract: Criminalization and interdiction actions lead to the consolidation of “local governance mechanisms,” parallel to the state, and “negotiation actions (corruption)” with some corrupt members of the PNP and FFAA in order to avoid being subject to interdiction. The policy recommendations of this Policy Brief are summarized in conceiving illegal mining as part of the mining sector, prioritizing the prevention of illegal mining and focusing on commercialization as the axis of interdiction. Abstract: i)The NEW Law must be based on technical information that characterizes the activities and actors in its value chain; ii) The NEW Law must be inclusive of other metals such as copper, tin, rare earth elements, and others; iii) The NEW Law must be inclusive for Quechua-speaking and Indigenous users; iv) The NEW Law must be proactive with exploitation contracts, whether with a PPM, PMA, or Medium and Large-Scale Mining; v) The NEW Law must protect fragile ecosystems, Protected Natural Areas (PNAs). Abstract: It focuses on the examination of select instances involving small-scale gold producers who find themselves in the advanced stages of mining formalizationnt (IGAC). The case studies, drawn from the provinces of Sandia, Carabaya, and San Antonio de Putina, provide an invaluable lens through which to appraise the deficiencies and external factors associated with the formalization.

Abstract: Notably, one of these emergent dynamics is the upsurge in mining and hydrocarbon extraction activities, along with their subsequent impact on regions characterized by significant biodiversity. Additionally, these activities exert their influence on the communities residing within or in the vicinity of these operations.
